Terms of Service

agentOS ("the Service") is a WhatsApp automation and appointment-booking platform operated by Code Bunny ("we", "us"). These Terms govern your access to and use of the Service. By signing in you agree to be bound by these Terms.

You are responsible for the security of your account and for all activity that happens under it. Keep your password confidential. Notify us immediately at notifications@codebunny.net of any unauthorised use.

You must be at least 18 years old and legally able to enter into a binding contract to use the Service.

You agree not to use the Service to:

• Send unsolicited bulk messages, spam, or content that violates WhatsApp's Business Messaging Policy or the terms of your chosen provider (Twilio, Meta).
• Send content that is illegal, harassing, defamatory, obscene, fraudulent, or that infringes on the rights of others.
• Attempt to reverse-engineer, decompile, or gain unauthorised access to the Service's systems.
• Resell, sublicense, or white-label the Service without a written agreement with us.
• Use the Service to build a competing product or scrape the Service's data.

You are solely responsible for the content of the messages your bot sends and for obtaining any consents required by law (e.g. opt-in for marketing messages under GDPR / DPDP / TCPA).

You retain full ownership of the content you upload, the messages your bot sends, and the qualification / booking data you collect. You grant us a limited, non-exclusive license to store, process, and transmit that content strictly to operate the Service on your behalf.

The Service integrates with third-party providers (Twilio, Meta WhatsApp Cloud API, Google Calendar, Zoom, your SMTP relay, and LLM providers via Emergent). Your use of those services is governed by their own terms. We are not responsible for the availability, security, or actions of third-party services, but we will use commercially reasonable efforts to keep our integrations working.

Where the Service is offered as a paid plan, fees are stated separately at the point of subscription. Fees are non-refundable except where required by law. You are responsible for the fees you incur with your underlying WhatsApp provider, LLM provider, and any other third-party services.

We aim for high availability but do not guarantee uninterrupted service. We may add, modify, or remove features at any time. If we make a change that materially reduces the functionality you rely on, we'll give you at least 30 days' notice via email or in-app banner.

You may stop using the Service at any time. To delete your account and data, email notifications@codebunny.net.

We may suspend or terminate your account if you materially breach these Terms, if required by law, or if your use poses a risk to the Service or other users. Where reasonably possible, we'll give you notice and a chance to cure.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT. LLM-GENERATED CONTENT MAY OCCASIONALLY BE INACCURATE OR INAPPROPRIATE — YOU ARE RESPONSIBLE FOR REVIEWING BOT OUTPUT AND FOR THE MESSAGES SENT FROM YOUR ACCOUNT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE FEES YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS.

You will indemnify and hold us harmless from any claim arising out of (a) your content or messages, (b) your violation of these Terms, or (c) your violation of any law or third-party right.

These Terms are governed by the laws of India. The courts of Delhi will have exclusive jurisdiction over any dispute arising out of these Terms, subject to any mandatory consumer-protection law that applies to you.

We may update these Terms from time to time. If we make a material change, we'll notify you at least 14 days before it takes effect. Continued use after the effective date means you accept the update.
